- automatically update upon booking deposit, the rental planning permanently
available for you on the website www.kaaxan.com
- Immediately send you an e-mail confirmation of the booking
- cash the client for you with 100% of agreed upon public rental amount
by credit card and before client’s arrival date.
- deposit on account of your choice free of fees the charged rental amount
minus booking commission 25 days prior arrival of client.
GENERAL AGREEMENT BETWEEN Kaaxan.com AND OWNER OR PROPERTY MANAGER
Owner
or unit Manager duties
On charging Kaaxan with the renting of his property, the owner commits
to:
- Show Kaaxan around his property explaining all hidden details of his
property, and provide a detailed description of the unit, as well as a
list of amenities contained in the unit
- Certify that all information given about the unit is true and immediately
advise upon any change
- Advise Kaaxan upon changing organization of rooms or listed appliances
- Deliver a clean property ready to rent and supplied with basic energy
and house supplies before each rental
- Pay for expenses of consumption of gas, electricity, water and all bills
related to property at any time
- Accept commission of Kaaxan for service
- Advise of personal or other Kaaxan’s bookings immediately of unavailability
of unit
- Provide Kaaxan with 12 faithful pictures of the unit
- Answer to Kaaxan's offers of promoting his unit
Minimum
property amenities
The owner guarantees to provide a unit which is at list equipped with
functioning and clean with fans and air conditioning:
- 2 sets of sheets for all beddings
- 2 sets of Towels for all bathrooms
- Beach towels enough for full capacity
- Basic set of Kitchen utensils
- Amigo cell phone with number (if possible)
Owner agrees to accept and pay for suggested replacement of these items
by Kaaxan, should they become used-up.
Payment
terms and bank accounts
Revenues collected for a rent minus compensation will be available for
owner 25 days prior to guest's planned arrival, and will be transferred
at Kaaxan’s expenses to owner’s or unit manager’s account
of his choice.
Revenues, diminished with Kaaxan’s compensation will be deposited
in following account:

Compensation
Kaaxan provides tenant, and owner or unit manager manages rental occupation;
Kaaxan shall receive sales commission to be agreed upon.
Additional 14%VAT on these percentages or amounts will apply upon necessary
invoicing to owner or unit manager.
Cancellation
Policies
In case a cancellation should occur on a booking confirmed by Kaaxan to
client and owner or property manager, Kaaxan will manage the case as follows,
depending on the date of cancellation and the reason for this cancellation:
1. Cancellation of client occurring more than 60 days prior to booked
arrival:
Kaaxan advises the owner or property manager so he can update his planning,
and pays 100usd for indemnification purposes.
2. Cancellation of client occurring between 59 an 30 days prior to arrival:
Kaaxan will pay owner or property manager 50% of total rental amount agreed
upon minus 3% of this amount as financial costs and minus 270usd administrative
fees.
3. Cancellation of client occurring within 29 days prior to arrival:
Kaaxan will pay owner or property manager 100% of rental amount minus
3% of this amount as financial costs and minus 270usd administrative fees.
4. Cancellation of bookings for Christmas, New Years and Easter holidays
are subject to 100% paying from Kaaxan to owner or property manager, starting
from 7 days after booking on website, regardless of time of cancellation,
minus 3% of this amount as financial costs and minus 270usd administrative
fees. This special dates need to be defined to us by yourself in advance.
5. In the event the booking needs to be cancelled by Kaaxan because client
has not complied with his payments on time or in its correct amount
a. Cancellation of Kaaxan occurring between 50 and 45 days prior to arrival:
Kaaxan advises the owner or property manager so he can update his planning,
and pays owner or property manager 100usd for indemnification purposes.
b. Cancellation of Kaaxan occurring within 20 and 15 days prior to arrival:
Kaaxan will pay owner or property manager 50% of rental amount minus 3%
of this amount as financial costs and minus 270usd administrative fees,
online planning is updated within 48h.
6. In the event that the booking needs to be cancelled because the property
is unavailable due to damage from hurricane, flood, fire, owner or property
manager agrees not to receive any indemnification of part of Kaaxan for
cancelled reservation, and Kaaxan will not pay rental amounts to owner
or property manager.
7. In the event that the booking needs to be cancelled because the property
is unavailable due to repairs not being completed on time, the selling
of the property, owner or property manager agrees not to receive any indemnification
of part of Kaaxan for cancelled reservation and agrees to pay to Kaaxan
270usd administrative cost plus 3% of the amount already paid by the client
to Kaaxan, and rental amounts will not be paid by Kaaxan to owner or property
manager.
8. In the event Kaaxan submits a booking that owner or property manager
is unable to honour because the booking dates were not available and Kaaxan
was not informed on time of this unavailability, Kaaxan will charge owner
or property manager with a penalty of 50usd in the case the client can
be relocated and the booking kept; on the contrary the penalty will be
100usd.
These amounts will be paid or required to owner or property manager 10
days after the cancellation notice from the client, and only if the client
was up to date with his payments; online planning is updated within 48h.
Should a cancellation occur less than 25 days prior to arrival, when Kaaxan
has already paid the owner of agreed upon rental amounts, Owner or property
manager agrees to give back any amount due according to preceding points
1 to 8.
Notice
and Communications
All notices, requests, demands or other communications hereunder shall
be in writing, by e-mail, validated upon acknowledged receipt.
Owner or manager and Kaaxan will be communicating through e-mail o fax.
Owner and Kaaxan accept that all communications, information, agreements,
advises, that he should receive from Kaaxan by e-mail or fax, satisfy
any type of legal requirements saying communications should be In writing.
